CPSC Rules Amazon Must Handle Recalls for Hazardous Items

U.S. Consumer Product Safety Commission (CPSC), in a landmark decision, has ruled that Amazon is responsible for managing recalls of hazardous products sold on its marketplace, a decision that has significant implications for the online retail giant. This ruling comes after the CPSC found that Amazon had inadequately addressed the recall of over 400,000 dangerous items, including defective carbon monoxide detectors, hazardous hairdryers, and flammable children’s pajamas.

The CPSC’s decision, announced on Tuesday, mandates that Amazon follow rigorous recall procedures to prevent unsafe products from being used, gifted, or resold. The commission criticized Amazon for not fully complying with recall requirements, which include notifying the public through clear, accessible means and facilitating the disposal of recalled products. According to the CPSC, Amazon’s approach had been insufficient as it merely notified customers of a “potential safety issue” rather than explicitly declaring it as a recall. The notices issued by Amazon were also lacking in detailed imagery of the hazardous items and did not provide strong incentives for customers to return or destroy the dangerous products.

Amazon had initially argued that it should not be held responsible for recalls involving third-party sellers on its platform. However, the CPSC’s decision upholds a previous ruling by an Administrative Law Judge (ALJ), who determined that Amazon, as a “distributor,” bears responsibility for ensuring recalls are managed effectively. The ALJ’s ruling, which was affirmed by the CPSC, marks a significant shift in how recalls for products sold through online marketplaces are handled.

The affected products sold between 2018 and 2021 had various safety issues, ranging from the risk of electric shock to potential fire hazards, posing serious dangers to consumers. Despite Amazon’s efforts to stop selling these products and to notify buyers, the CPSC found these actions inadequate in preventing potential harm.

This decision reinforces the CPSC’s stance that online marketplaces must adhere to the same safety standards as traditional retailers when it comes to product recalls. The ruling emphasizes the need for thorough communication and effective recall strategies to safeguard public health and safety. As a result, Amazon is now required to enhance its recall procedures to align with these standards, ensuring that hazardous items do not remain in consumers’ hands.
